Terms and Conditions (T&Cs) for Buri Sport

1. Scope and Provider

hereinafter referred to as “Buri Sport,” and its customers.

They apply in particular to:

  • the rental of skis, snowboards, sleds, clothing, and other sports equipment

  • Ski and snowboard lessons

  • Equipment service and repairs

  • VIP services

  • guided hikes, bike tours, and other outdoor activities

  • The sale of clothing, accessories, souvenirs, and other merchandise

By completing a reservation, order, or booking, or by using a service, these Terms and Conditions are deemed accepted.

Any deviating agreements require express confirmation by Buri Sport.

2. Offer, Reservation, and Conclusion of Contract

The offers presented on the website, in price lists, brochures, or other communication materials are generally subject to change and are subject to availability.

A request submitted online, by phone, via email, or through an inquiry form does not constitute a guarantee of the availability of the desired equipment or service.

A contract is concluded as soon as Buri Sport confirms the reservation or booking or delivers the agreed-upon service.

In the event of obvious pricing, typographical, or system errors, Buri Sport is entitled to correct the erroneous booking. The customer will be informed of this as soon as possible and may confirm the booking under the corrected terms or cancel it free of charge.

For rentals, there is generally no entitlement to a specific model, color, or year of manufacture, unless this has been expressly confirmed.

The reserved rental category is decisive.

3. Prices and Payment

Unless otherwise stated, all prices are in Swiss francs and include the applicable value-added tax.

The prices communicated at the time of reservation or conclusion of the contract apply.

Depending on the offer, payment may be made:

  • in advance online

  • upon pickup

  • at the start of the service

  • or as agreed upon individually.

For rentals lasting multiple days, the rental price is based on Buri Sport’s current pricing structure.

Additional services, upgrades, extensions, or services requested after the fact will be billed separately.

4. Equipment Rental

The rental equipment remains the property of Buri Sport for the entire rental period.

The customer agrees to use the rental equipment with care and exclusively for its intended purpose.

Transferring the rental equipment to third parties is not permitted without Buri Sport’s consent.

The customer is obligated to provide complete and accurate information when selecting and adjusting the equipment. This applies in particular to:

  • Height

  • Weight

  • Age

  • Riding ability

  • Shoe size

  • Additional information relevant to equipment fitting

Any obvious defects or damage must be reported to Buri Sport as soon as possible after pickup.

Normal wear and tear resulting from proper use is included in the rental price.

Buri Sport is entitled to require a deposit or appropriate security upon pickup of the rental equipment. Cash, a valid ID card, passport, or driver’s license may be required as security.

5. Exchange of Rental Equipment

Rental equipment may be exchanged free of charge during the rental period, subject to availability, within the booked rental category.

An upgrade to a higher rental category is possible at any time, subject to availability. In this case, the corresponding price difference will be charged.

When switching to a lower-priced rental category, there is generally no entitlement to a refund of the price difference, unless Buri Sport expressly confirms otherwise in writing.

There is no entitlement to a specific model or brand when exchanging equipment.

6. Rental Period and Return

The rental equipment must be returned to the agreed-upon location no later than 30 minutes before closing time.

In the event of a late return, Buri Sport is entitled to charge for the additional rental period in accordance with the currently valid price list.

An extension of the rental period is generally possible, provided the equipment in question has not been reserved for another customer.

The extension should be arranged with Buri Sport before the original rental period expires.

Rental equipment must be returned in person or via an expressly agreed-upon pickup service.

Leaving equipment unattended in front of a store does not constitute a proper return. In the event of loss or theft of an unattended item, the renter is liable for the resulting damage or loss in accordance with applicable laws.

7. Damage, Loss, and Theft

The customer is liable, within the scope of statutory provisions, for loss, theft, and damage to the rental equipment resulting from improper use, lack of care, or other circumstances for which the customer is responsible.

Normal wear and tear resulting from intended use will not be charged.

Buri Sport must be notified immediately of any loss, theft, or significant damage.

In the event of theft, Buri Sport may require the customer to provide a police report.

For lost or irreparably damaged rental items, Buri Sport may charge the current market value or reasonable costs for replacement or repair.

8. Optional Insurance for Rental Items

Optional insurance for the rental equipment is available at a cost of 10% of the rental price.

The insurance covers damage to and theft of the insured rental equipment, provided the customer exercises due care.

In particular, no insurance coverage applies in cases of intentional or grossly negligent conduct. Gross negligence may be deemed to exist, in particular, if rental equipment is left unattended in front of a store, in a publicly accessible location, or in any other obviously unsafe place.

In the event of loss, theft, or damage, Buri Sport must be notified immediately. In the case of theft, a police report may also be required.

If there is no insurance coverage or if damage is not covered by the insurance, the renter is liable for the resulting damage or loss within the scope of statutory provisions.

9. Ski and Snowboard School

Private lessons and other instructional services are offered subject to availability.

Advance reservations are required and must be confirmed in writing by Buri Sport.

The specific meeting place, lesson time, instructor, and other organizational details will be agreed upon with the customer.

The customer is obligated to provide Buri Sport or the instructor with truthful information regarding their skill level and any other circumstances relevant to the safe conduct of the lesson. In case of doubt, the customer must contact Buri Sport to determine their skill level.

Participation in ski and snowboard lessons requires a level of physical fitness appropriate to the circumstances.

The safety instructions of the instructors, as well as the applicable rules of the ski resort and the ski lifts, must be followed.

Buri Sport or the responsible instructor is authorized to adjust, interrupt, or cancel the lesson if the safety of participants or other persons is at risk.

10. Guided Hikes, Bike Tours, and Outdoor Activities

For guided hikes, bike tours, and other outdoor activities, the agreed-upon requirements regarding physical fitness, equipment, and experience apply.

Participants are required to inform Buri Sport before the start of the activity of any circumstances that could significantly impair their ability to participate safely.

Instructions from the responsible guide must be followed.

Buri Sport may adjust the route, duration, or conduct of an activity for safety reasons, due to weather conditions, terrain conditions, or other external circumstances.

To the extent that additional legal requirements apply to individual activities, these remain reserved.

11. VIP Service, Delivery, and Pickup

If agreed upon, Buri Sport will deliver rental equipment directly to the participant’s lodging or to an agreed-upon pickup location and will pick it up again at the end of the rental period.

This is subject to the condition that the agreed-upon pickup location is accessible to Buri Sport and that the necessary information has been provided in a timely manner.

The customer must ensure that the handover or return can take place at the agreed-upon time.

Responsibility for the rental equipment is transferred to the customer upon handover and ends upon proper return or pickup by Buri Sport.

12. Equipment Service and Repairs

Buri Sport performs service and maintenance work on skis, snowboards, and other sports equipment in accordance with the agreed-upon order.

Prices and cost estimates are provided for informational purposes only, unless a binding fixed price has been expressly agreed upon.

If, during the work, Buri Sport discovers additional damage or necessary extra work that significantly exceeds the originally expected scope, the customer will be informed, if possible, before any additional work subject to a fee is performed.

Buri Sport is not liable for pre-existing material damage that was not apparent at the time of acceptance, provided that Buri Sport is not at fault.

13. Sale of Goods

To the extent that Buri Sport sells clothing, accessories, souvenirs, or other goods, the applicable legal provisions and any manufacturer’s terms and conditions shall apply.

Manufacturers’ warranty coverage is governed by their respective warranty terms.

Defects should be reported to Buri Sport as soon as possible after their discovery.

There is generally no right of return for goods free of defects. A voluntary exchange may be made upon consultation with Buri Sport.

14. Cancellations and No-Shows

In the event of a cancellation by the customer or a no-show, there is generally no entitlement to a refund of payments already made, provided that Buri Sport would have been able to provide the booked service in accordance with the contract.

In individual cases and upon prior agreement, Buri Sport may grant a rebooking, credit, or a full or partial refund.

Mandatory legal claims remain reserved.

If Buri Sport is unable to provide a confirmed service, we will, where possible, offer a rescheduling or an equivalent alternative. If this is not possible or would be unreasonable for the customer, the amount already paid for the service not provided will be refunded.

15. Weather, Snow Conditions, and Mountain Railways

Snow, weather, and trail conditions, as well as the operation of mountain railways and other transportation facilities, are beyond Buri Sport’s control.

Consequently, restrictions on individual facilities or slopes do not automatically entitle the customer to a refund for rental services already received.

If a service directly owed by Buri Sport cannot be provided for safety reasons or due to exceptional external circumstances, Buri Sport will endeavor to find an appropriate alternative solution.

16. Personal Responsibility and Insurance

Skiing, snowboarding, sledding, biking, and other outdoor activities involve inherent risks.

Customers are personally responsible for ensuring they have adequate insurance coverage for the booked activity.

This may include, in particular but not exclusively:

  • Accident insurance

  • Health insurance

  • Liability insurance

  • Travel insurance

  • Search and rescue costs

The customer remains responsible for driving and behaving in a manner appropriate to their skill level and the prevailing conditions.

17. Liability

Buri Sport is liable for damages caused by intentional or grossly negligent conduct on the part of Buri Sport.

Unless otherwise provided in these Terms and Conditions, the statutory liability provisions apply.

To the extent permitted by law, Buri Sport shall not be liable for personal injury or property damage resulting, in particular, from:

  • failure to follow safety instructions or guidelines provided by Buri Sport or its employees

  • incorrect or incomplete information provided by the customer

  • improper or inappropriate use of the rental equipment

  • a riding style or behavior that is not adapted to the individual’s skill level or the prevailing conditions

  • the typical and natural risks associated with skiing, snowboarding, sledding, biking, and other outdoor activities

  • the conduct of third parties

  • Weather, snow, slope, or terrain conditions, as well as other circumstances beyond Buri Sport’s control

Buri Sport reserves the right to be held liable for damages caused intentionally or through gross negligence, as well as for other cases of liability mandated by law.

18. Data Protection

Buri Sport processes personal data in connection with reservations, rentals, sales, and services in accordance with applicable data protection regulations.

Further information on the processing of personal data can be found in Buri Sport’s current Privacy Policy. The Privacy Policy is available separately on the website.

19. Force Majeure

Buri Sport shall not be liable for the non-performance or delayed performance of a service to the extent that such non-performance or delay is caused by events beyond Buri Sport’s reasonable control.

These may include, in particular:

  • Natural disasters

  • Extreme weather conditions

  • Avalanche danger

  • Official orders or closures

  • Failure of transportation systems

  • Extraordinary traffic disruptions

  • Similar extraordinary events

To the extent possible, Buri Sport will endeavor to provide an appropriate alternative solution in such cases.

20. Languages

These Terms and Conditions are provided by Buri Sport in German, French, and English. If the Terms and Conditions are not available in the language requested by the customer, the customer is responsible for obtaining a suitable translation prior to entering into the contract and for ensuring that the content of the Terms and Conditions is understood.

In the event of any discrepancies between different language versions, the German version shall prevail, unless mandatory law provides otherwise.

21. Governing Law and Jurisdiction

Swiss law applies to the contractual relationship. The place of jurisdiction is the Cantonal Court of Bern in the Canton of Bern.

Should any individual provision of these Terms and Conditions be wholly or partially invalid, the remaining provisions shall remain valid. The invalid provision shall be replaced by a legally permissible provision that comes as close as possible to its original purpose.

22. Amendments to the Terms and Conditions and Final Provisions

Buri Sport may amend these Terms and Conditions at any time for future contracts.

For bookings that have already been confirmed, the version valid at the time the contract was concluded generally applies.

Should any individual provision of these Terms and Conditions be wholly or partially invalid or unenforceable, the remaining provisions shall remain unaffected.

The invalid provision shall be replaced by the applicable statutory provisions.
